Kelly Rutherford reunites with her children in New York

Kelly Rutherford has been reunited with her 6-year-old son and 8-year-old daughter in New York City, and the children are set to spend the summer in the United States.

People magazine said the actress and her beau Tony Brand picked up her children Friday, however the kids are scheduled to return to their father at the end of their vacation.

Rutherford has been traveling back and forth between her home in America and Monaco where her ex-husband, German businessman Daniel Giersch, has lived with their children since 2012.

Rutherford remains entrenched in a custody battle with Giersch, whom she divorced in 2009.

A U.S. judge subsequently allowed Giersch to temporarily take the children to Europe after his visa was revoked, with the understanding that Giersch would ultimately resolve the travel issue, his children would return home to America and he would be permitted to visit them. However, Rutherford has alleged Giersch has failed to live up to his end of the bargain.
