A Los Angeles judge dismissed a felony charge against a 46-year-old man accused of stalking US teen actress and singer Selena Gomez. Superior Court Judge Edmund Clarke Jr. said Thomas Brodnicki "lacked specific intent to cause the victim fear," according to Sandi Gibbons of the District Attorney's Office. Prosecutors did not say whether they will refile the charges. "We disagreed and argued against dismissing the case, and we now are evaluating our next step," said Gibbons. Brodnicki pleaded not guilty earlier this month to stalking the 19-year-old "Wizards of Waverly Place" entertainer -- and girlfriend of teen sensation Justin Bieber -- between July and October. Another judge on November 3 issued a three-year protective order against Brodnicki approaching the actress. According to court documents, Brodnicki allegedly told a psychiatrist he traveled to Los Angeles to see Gomez, visited her workplace and said he had conversations with God about killing her. Gomez has starred in children's and teen TV shows including "Hannah Montana."
